Welcome to ServiceQuick.co.za (the “Platform” or “Website”), operated by ServiceQuick (Pty) Ltd (“ServiceQuick”, “we”, “us”, “our” or the “Company”), a private company duly incorporated in the Republic of South Africa with its registered address at [insert physical address – to be completed].
These Terms and Conditions (the “Terms”) and the Privacy Policy below together form a legally binding agreement between you (the “User”, “you” or “your”) and ServiceQuick. By accessing, browsing, registering an account on, or using the Platform in any way (including booking any service), you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy in their entirety. If you do not agree, you must immediately cease all use of the Platform.
These Terms apply to all Users, whether you are a customer seeking services (“Customer”) or an independent service provider offering services (“Provider”). Providers are required to accept separate Provider Terms (available upon application), but these general Terms also bind Providers.
IMPORTANT NOTICE:
1. Definitions and Interpretation
1.1 In these Terms, unless the context indicates otherwise:
1.2 Headings are for convenience only and do not affect interpretation. Words importing the singular include the plural and vice versa.
2. Acceptance of Terms and Eligibility
2.1 By creating an account, placing a Booking, or using the Platform, you confirm you are at least 18 years old (or the age of majority in your jurisdiction), have full legal capacity, and are not barred from using the Platform under South African law.
2.2 If you are using the Platform on behalf of a company, trust, or other entity, you represent that you have authority to bind that entity.
2.3 We may update these Terms at any time. Changes become effective 30 days after posting the updated version on the Platform with a new “Last Updated” date. Continued use after that date constitutes acceptance. We will notify registered Users via email where material changes occur.
3. The ServiceQuick Platform and Our Role
3.1 ServiceQuick operates an online marketplace that connects Customers with independent Providers for the Services listed on the Platform.
3.2 We do not employ Providers, control their actions, set their prices (beyond suggested ranges), supervise their work, or guarantee the quality, safety, legality, or timely completion of any Service. Providers are solely responsible for performing the Services in a professional, lawful, and competent manner.
3.3 We provide the technology, payment processing, booking system, and customer support only. All contracts for Services are formed directly between the Customer and the Provider upon acceptance of a Booking.
3.4 We reserve the right to refuse, suspend, or cancel any Booking or account at our sole discretion without notice or liability.
4. Account Registration and Security
4.1 You must create an account to book or offer Services. All information provided must be accurate, current, and complete. You agree to update it promptly.
4.2 You are solely responsible for maintaining the confidentiality of your password and account. Any activity under your account is your responsibility. Notify us immediately of any unauthorised use.
4.3 We may suspend or terminate accounts for suspected fraud, breach of Terms, or inactivity.
5. Booking, Scheduling, and Service Performance
5.1 All Bookings are subject to Provider availability and acceptance. We do not guarantee any Provider will accept or complete a Booking.
5.2 Customers must provide accurate property details, access instructions, and any special requirements (e.g., presence of pets, security codes, parking). Failure to do so may result in additional fees or cancellation.
5.3 For home-entry Services (cleaning, repairs, etc.), you authorise the Provider to enter your property at the scheduled time. You remain fully responsible for securing valuables and ensuring safe working conditions.
5.4 Providers may take before/after photos (with your consent) for quality and dispute resolution.
5.5 Special categories (Generator Hire 4+ days, Large Electrical jobs 12+ lights) use an enquiry form; final pricing and terms are agreed directly with the Provider.
6. Payments, Fees, and Billing
6.1 All payments are processed securely through the Platform. You authorise us (or our payment processor) to charge your chosen payment method for the full Booking amount plus any applicable ServiceQuick service fee, VAT, and other taxes.
6.2 Prices displayed are estimates; final amounts may vary based on actual time/materials (especially for time-based Services). You will be notified of any material increase before work begins.
6.3 For Generator Hire and certain Electrical jobs, deposits or full prepayment may be required.
6.4 Late payments or failed transactions may incur interest at 2% per month or the maximum allowed by law, plus recovery costs.
6.5 We may change pricing at any time with notice on the Platform.
7. Cancellations, Rescheduling, and Refunds (CPA & Platform Policy)
7.1 Customers may cancel or reschedule up to 24 hours before the scheduled start time without charge (subject to any Provider-specific policy).
7.2 Cancellations within 24 hours or no-shows may incur a cancellation fee of up to 50–100% of the Booking value, payable to the Provider and/or ServiceQuick.
7.3 In accordance with the CPA, where applicable (e.g., direct marketing), you have cooling-off rights, but these do not override reasonable cancellation charges for scheduled services.
7.4 Refunds (where due) will be processed within 7–14 business days to the original payment method. No refunds for completed or partially completed Services unless the Provider materially breaches.
7.5 Force majeure events (load shedding, weather, traffic, etc.) may allow rescheduling without penalty at our discretion.
8. User Conduct and Responsibilities
8.1 You agree not to: misuse the Platform, post false reviews, harass Providers, provide unsafe working conditions, or engage in any unlawful activity.
8.2 You must comply with all applicable laws, including the CPA, ECTA, and POPIA.
8.3 Reviews must be honest, factual, and not defamatory. We may remove reviews that violate these Terms.
9. Provider-Specific Provisions
9.1 Providers must be registered, insured (where required), and comply with all labour, health & safety, and tax laws.
9.2 Providers agree they are independent contractors with no employment relationship with ServiceQuick or the Customer.
9.3 Providers must carry appropriate public liability insurance (minimum R5 million recommended) and provide proof upon request.
10. Intellectual Property
10.1 The Platform, all content, logos, software, and trademarks are owned by or licensed to ServiceQuick. You receive a limited, revocable licence to use the Platform for its intended purpose only.
10.2 You grant us a perpetual, royalty-free licence to use your reviews, photos, and feedback for marketing and Platform improvement.
11. User Content and Reviews
11.1 You retain ownership of your User Content but grant us a worldwide, irrevocable licence to display, reproduce, and use it on the Platform and in marketing.
11.2 We are not responsible for User Content and may remove it at any time.
12. Disclaimers and Warranties (Strong Protection)
12.1 THE PLATFORM AND ALL SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT ANY WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.
12.2 WE MAKE NO REPRESENTATIONS OR WARRANTIES REGARDING:
12.3 We do not guarantee that Providers are licensed, bonded, or insured. You use the Platform and book Services entirely at your own risk.
12.4 No advice or information obtained from us creates any warranty not expressly stated in these Terms.
13. Limitation of Liability
13.1 TO THE MAXIMUM EXTENT PERMITTED BY LAW (INCLUDING THE CPA WHERE APPLICABLE), SERVICEQUICK, ITS DIRECTORS, EMPLOYEES, AFFILIATES, AND PROVIDERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING LOSS OF PROFITS, DATA, GOODWILL, PROPERTY DAMAGE, PERSONAL INJURY, OR DEATH) ARISING OUT OF OR IN CONNECTION WITH THE PLATFORM OR ANY SERVICE, EVEN IF ADVISED OF THE POSSIBILITY.
13.2 OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ANY CLAIM SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY YOU TO SERVICEQUICK IN THE 12 MONTHS PRECEDING THE CLAIM.
13.3 This limitation applies regardless of the form of action (contract, delict, statute, etc.).
14. Indemnification
14.1 You agree to indemnify, defend, and hold harmless ServiceQuick, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or in connection with:
14.2 We reserve the right to assume the exclusive defence and control of any matter subject to indemnification, at your expense.
15. Termination
15.1 We may terminate or suspend your account or access to the Platform at any time, with or without cause or notice.
15.2 Upon termination, all rights granted to you cease immediately, but surviving provisions (including liability limitations, indemnification, and governing law) continue.
16. Governing Law and Dispute Resolution
16.1 These Terms are governed by and construed in accordance with the laws of the Republic of South Africa.
16.2 Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the High Court of South Africa (Gauteng Division, Johannesburg), provided that we may, at our option, refer the dispute to mediation or arbitration under the rules of the Arbitration Foundation of Southern Africa (AFSA) before court proceedings.
16.3 You agree to attempt good-faith resolution before litigation.
17. Miscellaneous
17.1 Entire Agreement – These Terms (including the Privacy Policy) constitute the entire agreement. 17.2 Severability – If any provision is held invalid, the remainder remains enforceable. 17.3 No Waiver – Failure to enforce any right does not constitute a waiver. 17.4 Assignment – You may not assign your rights; we may assign freely. 17.5 Force Majeure – We are not liable for delays or failures caused by events beyond our reasonable control (including load shedding, strikes, pandemics). 17.6 Notices – All notices must be in writing to info@servicequick.co.za. 17.7 Survival – Sections 10–14, 16, and 17 survive termination.
